Employment Litigation

Fitzhugh & Mariani represents employers in all aspects of employment litigation before the Equal Employment Opportunity Commission, the Massachusetts Commission Against Discrimination, and in state and federal courts. From the initial charge of discrimination through appeal, our attorneys have the experience and expertise to handle the most complex of allegations. We routinely obtain summary judgment or partial summary judgment for our clients in cases involving claims of gender, age, race, and disability discrimination. Our attorneys have also handled cases involving novel theories of liability like reverse race discrimination. We have also successfully represented clients in claims of discrimination asserted by non-employees, including consumer claims of "racial profiling."

Our attorneys also handle wage and hour litigation arising under the Fair Labor Standards Act ("FLSA") and under Massachusetts’ onerous state statutes. In addition to handing employment litigation in Massachusetts, Fitzhugh & Mariani has represented employers in Connecticut at the Connecticut Commission on Human Rights and Opportunities as well as in state and federal courts. From defeating efforts to certify class actions to negotiating settlements with the Attorney General's office, Fitzhugh & Mariani's attorneys can achieve cost-effective solutions for virtually any business facing wage and hour claims.
