Mr. Volkin has handled environmental, commercial, business tort, municipal and professional liability litigation. Since becoming affiliated with Fitzhugh & Mariani LLP, Mr. Volkin has handled various matters for both small and large corporations and businesses, including cases involving CERCLA, M.G.L. c.21E, M.G.L. c.93A, MTCA, the Lanham Act, the Sherman Act, shareholder derivative suits, contract actions and tort actions against professionals such as real estate brokers and corporate directors and officers. A former United States Navy Judge Advocate, Mr. Volkin previously tried over 115 courts martial and administrative hearings and defended the U.S. Navy in civil lawsuits.

As a member of the Environmental group since joining the firm seven years ago, Mr. Volkin has also worked in representing clients in state hazardous waste liability litigation from the demand process through post-trial to determine responsibility for the release of hazardous substances. He also has significant experience in representing parties in proceedings and negotiations before the MA Department of Environmental Protection including negotiating settlements of administrative orders and consent decrees for the cleanup of hazardous waste sites, and negotiating access agreements.

Experience includes:

MtBE counsel for Massachusetts private actions for ChevronTexaco, Texaco and Star Enterprise.

Represented over 20 additional companies in environmental litigation relating to the release of fuel from storage tanks.
