Ms. Mariani has handled complex products liability, premises liability, tort, environmental, commercial, and employment discrimination litigation in Massachusetts, Connecticut and Maine for a number of national and multi-national corporations. Before becoming affiliated with Fitzhugh & Mariani LLP, she worked in general practice, boutique litigation, and large firm settings.
Attorney Mariani recently obtained a judgment denying nationwide class certification in an employment law action brought by a number of Skycaps against our client, American Airlines; this ruling of the district court was affirmed when the plaintiffs’ petition for a Rule 23(f) appeal was denied by the First Circuit in DiFiore et als v. American Airlines, First Circuit No. 07-8032, December 13, 2007 (entering judgment). The district court had determined that the case would be unmanageable, and in opposing the plaintiffs’ Petition, American contended that the First Circuit should reject it the way a court would refuse a proposed amendment to a pleading, that even if allowed, would not state a viable cause of action. Attorney Mariani indeed did convince the First Circuit to deny the plaintiffs’ Petition, thus foreclosing them from the opportunity to file an appeal of the district court’s order denying class certification.
